Reasons
Punishment of the crime
1. On April 18, 2016, Defendant A: (a) dumped cigarette butts on the street before a mobile phone agency operated by Party B in Gangnam-gu Seoul, Gangnam-gu, Seoul, without permission; (b) controlled the G public officials of the Government of the Gangnam-gu, Gangnam-gu, Seoul; (c) refused to present identification cards to the Defendant; and (d) carried them into a mobile phone agency.
Accordingly, the Defendant, who prevents the Defendant, committed violence against the body of G in both hands, and on May 11, 2016, the Defendant was indicted for non-detained with the Seoul Northern District Court due to interference with the performance of official duties and was tried.
In order to argue that the Defendant possessed an identification card at the time and stated that “G would not be able to present an identification card to the mobile phone agency with an identification card, G would prevent him from entering the mobile phone agency with an identification card,” even though the Defendant stated that “B was not a memory on April 18, 2016” and “B was not written in a fact-finding certificate.”
On April 18, 2016, as written in a fact-finding certificate, B had B make a false testimony to the purport that “The testimony was made with an identification card given within the agency,” and had B make a false testimony to the same purport.
Accordingly, on November 30, 2016, B appeared and taken an oath as a witness of the Defendant’s case interfering with the performance of official duties against the Defendant at the Seoul Northern District Court Decision 401, Seoul Northern District Court Decision 2016 Godan1580, which was located in Dobong-gu Seoul, Seoul, Seoul, on November 30, 2016, and testified to the effect that “A was interfered with A’s official duties outside the agents operated by No. 1580, Apr. 18, 2016, and was not a public official of A who tried to enter into the store to find identification cards, and made a false testimony to the effect that “A was able to ask for a public official’s identification card on behalf of the agency, and make him/her enter the store.”
In this respect, the Defendant instigated the perjury to B.
