Defendant shall be punished by a fine of KRW 5,000,000.
If the defendant does not pay the above fine, 50,000 won shall be paid.
Reasons
Punishment of the crime
On April 14, 2011, the Defendant sentenced the Suwon District Court to four months of imprisonment and eight months of imprisonment for a violation of the Act on the Control of Narcotics, Etc., and completed the execution of the sentence in the Gwangju Prison on April 27, 2012.
Defendant is not a narcotics handler.
1. On June 2012, the Defendant: (a) returned the psychotropic drugs that B entrusts to C; (b) was psychotropic drugs that B left to C; and (c) went to administer with B.
Accordingly, on June 2012, 2012, the Defendant returned approximately 0.14g of philophones left to C in front of the Homan in the early street of the 2012 Homan, and around that time, the Defendant divided approximately 0.07g of the said philophones from Defendant’s vehicle parked on the street in front of the above D neighboring convenience store to two of the said philophones for one time and injected them into their arms.
Accordingly, the Defendant conspired with B to administer philophones.
2. On June 17, 2012, the Defendant had a mind to purchase the penphone from E via B.
Accordingly, around 20:00 on June 17, 2012, the Defendant transferred KRW 600,000 to the deposit account in the name of G in the E management known by B, and purchased approximately 0.7 grams of the instant philopon from the first floor toilet in the Honam-si in the Gyeonggi-si, Gyeonggi-do around 22:00 on the same day, E purchased approximately 0.7 grams of the said philopon from B, who sought approximately 0.7 grams of the said philopon.
3. On June 18, 2012, the Defendant received and delivered approximately 0.14g of the penphones purchased as in the preceding two paragraphs to B on June 18, 2012.
4. Around June 18, 2012, the Defendant, who administered phiphones, put approximately 0.07 grams out of the phiphones purchased as of June 18, 2012, into a single-use injection machine, and injected them into the arms after dilution, at around 00:0,00.
