A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around November 2015, the Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter “Special Cases Concerning the Punishment, etc. of Sexual Crimes”), took photographs of two copies of the victim’s photographed her body in the her mother room, without obtaining the consent of the victim C (V, 51 years old), using a camera attached to the Defendant’s mobile phone located in B, and without obtaining the consent of the victim C (V, 51 years old).

Accordingly, the defendant taken the body of another person, which could cause a sense of sexual shame by using a camera, against his will.

2. On January 3, 2016, at the entrance of E-factory located in D at Suwon, the Defendant sent one video image containing the body pictures of the victim, such as paragraph 1, to F, using the Defendant’s mobile phone, and made the Defendant reach a video that may cause a sense of sexual humiliation or aversion through a communication medium with the intent to arouse or satisfy his/her own or another person’s sexual desire.

3. The Defendant violated the Act on Promotion of the Use of Information and Communications Network Utilization and Information Protection, Etc. on May 14, 201, when: (a) at H dormitories located in Jung-gu Incheon Metropolitan City on May 14, 201; (b) from the H dormitory located in Jung-gu Incheon Metropolitan City on a yearly basis until January 2016, the victimized person who was hedgingd in a relationship with the Defendant does not call for the Defendant; (c) and (d) Mababbba on December 12.

In addition, the Defendant sent the text message from May 14, 201 to May 25, 2016, 13 times in total, from around 21:01 to around 07:10 on May 25, 2016, to the victim.

Accordingly, the defendant repeatedly makes words causing fears and apprehensions through information and communications networks.
