A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2018 Highest 1087] On May 9, 2017, at the Defendant’s residence located in Busan Eastdong-gu F apartment 103 303 dong-gu, Busan around May 9, 2017, the Defendant made a false statement to the effect that “A victim G purchases EOS M10” using mobile phones with the content of “A purchase of digital camera EOS M10”, and made a false statement to the effect that “I will send the digital camera to the victim if the price of the goods is deposited.”
However, even if the defendant receives money from the injured party, he did not have the intention or ability to send the goods to the injured party.
Nevertheless, the Defendant, by deceiving the victim, received KRW 260,00 from the victim to the Agricultural Cooperative account under the name of the Defendant, and received KRW 260,00 from around that time to October 13, 2017, totaling KRW 6,990,000 from around 21 times, such as the list of crimes in the attached Table.

The defendant deceivings the victim as above and transferred 300,000 won to the national bank account under the name of the defendant from the victim.

On March 27, 2018, the Defendant was sent KRW 100,00,000 to the Agricultural Cooperative account in the name of I, on the ground that, although late, the Defendant would have contacted the victim at a non-place located in Busan, it would have sent the Plaintiff with a false statement, it would have been transferred KRW 100,000 to the Agricultural Cooperative account in the name of I.
