A Imprisonment for 6 months, Defendant B, and Defendant C shall be punished by imprisonment for each of 8 months, and Defendant D shall be punished by a fine of 5 million won.

Punishment of the crime

[criminal records] Defendant B was sentenced to ten months of imprisonment for the opening of gambling in the Daejeon District Court’s Incheon Branch on June 9, 2016 and was released from the Daejeon District Court on December 23, 2016, and the term of imprisonment was terminated on February 11, 2017. Defendant C was sentenced to ten months of imprisonment for a crime of opening gambling at the Daejeon District Court’s Incheon Branch on June 21, 2018 and the said judgment became final and conclusive on June 29, 2018.

[Criminal facts]

1. Defendants B and D’s joint criminal acts established gambling places with the purpose of profit-making with E, F, G, H, etc.: E (one person’s name “I”) and G act as a custodian of warehouse; (i) Defendant B and F (one person’s name “J”) play the role of attracting people to play the remaining role necessary for the operation of the gambling place; (ii) leading the gambling place in the manner of “all books (total books)”; (iii) gambling with gambling participants; and (iv) Defendant D (one person’s name “K”) sent the gambling place” after removing gambling participants from the gambling place; and (iv) have the role of promoting the development of the gambling place at the place of gambling as a “path”.

피고인들은 위 공범들과 공모하여, 2017. 2. 22. 23:00 경부터 다음날 07:00 경까지 아산시 L 인근 야산에 천막을 설치한 다음 딜러가 화투 20매를 이용하여 패를 돌리면, 총책이 먼저 돈을 걸고 화투 패를 선택하고, 도박 참가자( 속칭 ‘ 찍 새’) 들이 나머지 화투 패에 돈을 걸어 선택한 뒤 화투 5매 중 3매를 이용하여 끝수의 합을 10 또는 20의 조합을 만든 후, 나머지 화투 2매의 끝수를 합산하여 높은 수를 가진 쪽이 승리하여 도금을 가져가는 속칭 ‘ 도리 짓고땡’ 도박장을 개설하고 도박자들 로부터 일정 수수료를 지급 받았다.
