1. Revocation of the first instance judgment.
2. The Defendant filed an application for adjudication against the Plaintiff’s claim on October 8, 2014.
Reasons
1. Facts of recognition;
A. From February 17, 2006, I divided C908 square meters of land for C 908 square meters in Yangju-si on March 12, 2010 into 102 square meters of land for C and D factory on March 12, 2010, and the said D factory site was divided into 595 square meters of land for D 12, 2010 and 211 square meters of land for E.
(hereinafter referred to as the “instant land”) and a ground factory are leased, and part of its affiliated buildings are newly constructed, and plastic recycling facilities, such as the items listed in the list of obstacles (hereinafter referred to as the “indemnites”), were installed, and registered under the name of J as the trade name and made plastic recycling business.
B. On December 23, 2008, I entered into a partnership agreement with K (I, on March 23, 2009, made business registration under the name of L in the name of K on March 23, 2009, and continued to engage in the said plastic recycling business. On April 7, 2009, I transferred its shares to the Plaintiff, who was living together with the said recycling business.
C. On April 1, 2010, the Plaintiff entered into a lease agreement with B on the instant land (actually, extension of the existing lease agreement), and the same year.
8. 30.F has registered its business in its trade name.
On March 27, 2012, there is a dispute between I and K with respect to the above business agreement, and on March 27, 2012, the above business agreement is agreed upon by K to pay settlement money to the Plaintiff and terminate the business, and thereafter, the Plaintiff runs the above plastic recycling business (hereinafter referred to as the “instant business”).
E. The two weeks Mayor is the implementer of G Road Packing Corporation, which is an urban/Gun planning facility project under the National Land Planning and Utilization Act (hereinafter referred to as the “National Land Planning Act”) on February 4, 2009 (hereinafter referred to as the “instant project”), and a purchaser consultation with B on the said D land and three parcels outside the above E land, and completed the registration of ownership transfer under the Defendant’s name on March 12, 2010, and the same year.
