1. Basic facts

A. The Defendant was the head of the Plaintiff (hereinafter “Plaintiff church”).

From January 2002 to July 201, the Defendant was engaged in the work of keeping “construction donation” in order to construct a new church building collected from the believers of the Plaintiff church.

B. On March 14, 2005, the Defendant terminated the said account while keeping the construction contribution funds of the Plaintiff church believers in the account of the Defendant’s agricultural bank account in the name of the Defendant, and deposited the total amount of KRW 19,776,503, which was deposited in the said account in cash and consumed them for personal purposes, such as children’s school expenses, etc. from the members in the Daejeon Si of Daejeon. From that time to January 3, 2008, the Defendant collected the total amount of KRW 56,607,767 (hereinafter “the instant embezzlement funds”) of the construction contribution funds of the Plaintiff church owned by the Plaintiff church and used them for personal purposes at will.
