1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. On September 13, 1994, the Plaintiff completed the registration of a disabled person as a person with a physical disability of grade 2, and applied for the payment of disability pension to the Defendant on March 11, 2014.

B. On June 20, 2014, the Defendant reviewed the Plaintiff’s disability grade and determined the Plaintiff’s comprehensive disability grade 3 on the ground that the Plaintiff’s disability status falls under the disability grade 3 (the main disability), and the disability grade 5 (the transformation).

The contents of the examination and decision entered in the above written decision shall be as follows:

▣ 지체장애(하지기능) 3급 - 장애등급 판정기준상 관절장애는 관절의 강직, 근력의 약화 또는 관절의 불안정이 있는 경우에 한하여 수동적 관절운동범위를 기준으로 하고, 기능장애는 척수 또는 말초신경계의 손상 등으로 인한 다리 전체의 운동기능장애(마비)가 있는 경우로서 이는 판정에 근거가 되는 영상자료 등으로 확인하며 신경학적인 결손을 보이는 부위와 검사 소견이 서로 일치하여야

함. 제출된 자료 등을 검토한 결과 의무기록지상 하지 근력 등급, 근전도 검사상 운동신경 손상 정도, 방사선 사진상 관절면의 상태와 관절운동범위, 추가 제출된 자료상 하지의 근위축 및 기능적 상태 등을 고려할 때 양측 하지는 등급기준에 해당할 만한 관절운동범위 제한이 인정되지 않으며, 우측 하지는 등급기준에 해당할 만한 마비상태로 인정되지 않으나 좌측 다리를 완전마비로 전혀 움직일 수 없는 상태로 인정되어 (좌)하지기능장애 3급으로 결정함. 한 다리를 완전마비로 전혀 움직일 수 없는 사람(근력등급 0, 1) ▣ 지체장애(변형) 5급 - 제출된 자료 및 방사선 사진 등을 검토한 결과 좌측 다리가 우측 다리보다 10cm 이상 짧은 상태로 인정되어 변형장애 5급으로 결정함. 한 다리가 건강한 다리보다 10cm ...
