A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

[2012 Highest 7101] Any person may not distribute or openly exhibit obscene videos through an information and communications network. However, around August 29, 2012, the Defendant connected an Internet file sharing site (www.ppop.com) with an ID (C) in his/her own name, and then posted an obscene video on the name of “specific users visiting a DNA pop-up with a sexual intercourse with a sexual intercourse with a sexual intercourse with a man and woman,” as shown in the attached Table 18 from August 26, 2012 to November 2, 2012.

Accordingly, the Defendant openly displayed obscene images on an information and communications network.

[2013No one may distribute or openly exhibit obscene videos through an information and communications network. However, around October 6, 2012, the Defendant, using a computer installed in the place, sent a notice to enable an unspecified number of users connected to the documentary transport to download the obscene video under the name of “http://www.q.com.com.” (hereinafter “Wtp”) with the Internet file-sharing site using a computer installed in that place, and then go back to a htp (/www.q.com.) with the ID in one’s name. The notice was given so that the Defendant may download the obscene video under the name of “http” (hereinafter “Wtp”).

Accordingly, the Defendant openly displayed obscene images on an information and communications network.
