A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date of the final judgment.
Reasons
Punishment of the crime
The defendant is the C representative director, Co., Ltd. of clean products manufacturing business.
1. On July 25, 2008, the Defendant: (a) in the Incheon Tax Office located in the Dong-gu Incheon, Incheon, Dong-gu, Incheon; (b) did not have been supplied goods or services from the EF character; and (c) despite having been supplied goods or services equivalent to KRW 42,143,60 from the EF Vice Governor (F prior to the change of the trade name) operated by the Defendant, the Defendant conspired with the above EF character to submit a false list of total tax invoices for individual suppliers, which is equivalent to KRW 92,943,50 from the above EF character, and KRW 124,065,000 from the above EF Vice Governor, submitted to the public official in charge of false name.
2. On October 25, 2008, the Defendant submitted a false list of total tax invoices by seller to a public official in default of name, in collusion with the above ENN, when he/she was supplied goods or services equivalent to KRW 92,805,40,00 from the above ENN character, despite that he/she was supplied goods or services equivalent to KRW 40,835,00 from the ENN character, and submitted a false list of total tax invoices by seller to a public official in default of name, as he/she was supplied with goods or services equivalent to KRW 120,212,60 from the above EN Vice Governor.
3. On January 25, 2009, the Defendant submitted a false list of total tax invoices by seller to a public official in default of name, in collusion with the above ENN, when the Defendant had been supplied goods or services equivalent to KRW 82,454,00,00 from the above ENN character, although he had not received goods or services from the ENN character. Despite having received goods or services equivalent to KRW 33,648,200 from the above ENN, the Defendant submitted a false list of total tax invoices by seller to the public official in default of name.
4. The Defendant at the above Incheon Tax Office on April 25, 2009, and the facts are goods or services from the Flab character, Inc.
