A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Sale and purchase of a Metepopopon (one-name “philopon”; hereinafter referred to as “philopon”);
A. The Defendant solely committed an offense: (a) 300,000 won was fluored from the end of June 2014 to the beginning of July 2014 to C in the street near the Namdong-gu Incheon Metropolitan City Safety Center; and (b) 300,000 won was fluored from C, which included approximately 0.2 g of philophonephones.
Accordingly, even if the Defendant is not a narcotics handler, the Defendant traded psychotropic drugs.
B. The Defendant and D, together with D, agreed to provide the purchase fund for phiphones, and the Defendant agreed to purchase phiphones from C with the purchase fund received as above.
1) On July 12, 2014, the Defendant was found to have 400,000 won (40,000 won) received from D on the street near the bus stops located in the Nam-gu Incheon Metropolitan City, Seo-gu, Incheon, for the first time, around the bus stops in front of the bus stops, and in return, purchased and sold psychotropic drugs in collusion with D even if the Defendant is not a narcotics handler. (2) On September 12, 2014, the Defendant: (a) on September 12, 2014, purchased psychotropic drugs in collusion with D; and (b) on September 12, 2014, the Defendant received 70,000 won (70,000 won) received from D on the street near the 119 Safety Center near the Nam-gu, Incheon Metropolitan City, for the first time; and (c) on the one hand, 300,000 won (0,000 won) c.
Accordingly, even if the Defendant is not a narcotics handler, the Defendant sold psychotropic drugs in collusion with D.
3. The Defendant and D, on November 23, 2014, intended to purchase from C one gram of opon from 1.2 million won, and D, on November 23, 2014, put KRW 80,000,00 in an envelope and put it on the back wheels of a passenger car parked on the side of a passenger car that was parked on the 3-dong autonomous container near the Incheon Southern-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-si.
