Reasons
Punishment of the crime
Defendant A, “2014 Highest 3786,” is a person operating G gas stations in Gyeongsan City F, and Defendant B is a person who delivers oil using delivery vehicles in G gas stations.
1. A petroleum retailer for oil sales shall not sell light oil as fuel for construction machinery;
A. On April 1, 2014, around 18:00, the Defendants: (a) ordered an outdoor parking lot located in the Jump truck in Mump Eup in Gyeonggi-si; (b) Defendant A was ordered to use a dump truck article in his/her name in his/her name; and (c) Defendant B received KRW 1,300 per liter for a dump truck, which is H construction machinery, using a mobile oil vehicle in his/her gas station, and oiled to 62 liters of light oil.

2. Violation of method of business (transfer sale) by Defendant A, a person operating a general retail shop, was prohibited from moving and selling dump trucks and concrete mixtures trucks to consumers using them, but he/she moved and sold dump trucks by means of directly supplying them to dump trucks, such as paragraph (1), at the time and place specified in paragraph (1), along with Defendant B, and at the same time and place.
As a result, the Defendants conspired to move and sell dump trucks to violate the business method of the general retail shop.

1. On August 2013, Defendant C and D conspireded to set fire insurance money to the victim Samsung Fire Marine Insurance Co., Ltd. after setting the vehicle into the JMW vehicle owned by Defendant C with fire in the early 2013.
