1. All appeals filed by the plaintiffs are dismissed.

1. The court's explanation on this part of the basic facts is the same as the reasoning of the judgment of the court of first instance under Article 420 of the Civil Procedure Act.

2. The parties' assertion

A. The plaintiffs' assertion L of this case not only is located near the 2km away from the cultivation of this case, but also consists of a large number of floors. Thus, due to changes in the direction and course of the implementation of the L construction project of this case, the embankment of this case (hereinafter "the embankment of this case") is erosioned and accordingly, it is sufficiently anticipated that damage to the plaintiffs will occur.

Therefore, the defendant had a duty to take measures to prevent damage, such as speed reduction, by conducting adequate environmental impact assessment before and after the execution of the LA construction project in this case, and to compensate the plaintiffs for the damage related to the embankment in this case.

Nevertheless, the Defendant did not perform its duty of compensation in violation of the Road Act and the Land Compensation Act, such as excluding the Plaintiffs from the subject of compensation related to the instant L construction project, etc.

In addition, the Defendant damaged the marine environment near the bridge due to the implementation of the instant L construction project, and accordingly, the Plaintiffs’ instant bank began from around 2012 to collapse, and some banks collapse, and the current bank collapses, thereby completely losing its function as a bank.

Therefore, the defendant is obliged to compensate the plaintiffs for damages equivalent to the cost of the bank restoration in accordance with the above Road Act, the Land Compensation Act, etc. and the Framework Act on Environmental Policy.

B. The defendant's assertion was conducted prior to the implementation of the L construction project of this case with an examination of the impact on the surrounding sea areas. As a result, the L construction project of this case is conducted.
