A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant in violation of the Act on Special Cases concerning the Settlement of Traffic Accidents is a person who is engaged in driving a B body-wide car.

On January 10, 2013, at around 23:26, the Defendant driven the said vehicle while under the influence of alcohol of 0.076% without a driver’s license, and proceeded at about 50km in the speed from the front of the water cooperative located in Yeonsu-gu Incheon Yeonsu-gu, Yeonsu-gu, Incheon at about 437, on a three-lane road.

The Defendant, by such occupational negligence, sustained injury to the victim C, such as catitis that requires approximately two weeks of medical treatment, injury to the victim E, who is the passenger of the victimized vehicle, such as catitis that requires approximately two weeks of medical treatment, and suffered injury to the victim F, who is the passenger of the harming vehicle, for approximately three weeks of medical treatment.

2. Violation of the Road Traffic Act (driving) and the Road Traffic Act (Free License) provided for in paragraph (1) of this Article, the Defendant driven the said vehicle at the 1km section of approximately 0.076% alcohol concentration without a vehicle driver’s license from the front day of the restaurant in the Yeonsu-gu Incheon Metropolitan City from the front day of the restaurant in the school of Yeonsu-gu to the place specified in paragraph (1) of this Article.
