Reasons

1. 공소사실 피고인은 상시 7명의 근로자를 사용하여 부천시 오정구 C 소재 D 대표로서 화장 퓸 용기 UV 코팅 업을 경영하는 사용자이다.

The Defendant worked from November 11, 2012 to January 30, 2015, and retired from office, on November 201, 2012, paid 11,958 won in total during working period as indicated in the attached Table of Minimum Wage Difference, as well as 4,920,115 won in total during the period of service, within 14 days from the retirement date on which the cause for payment occurred, without agreement between the parties on the extension of the payment date.

2. Determination

(a) Crimes of non-violation of intention: Article 109 (2) of the Labor Standards Act;

B. On June 2, 2016, after the institution of the instant indictment, a written agreement containing an intent that an employee does not want to punish the Defendant.

Judgment dismissing a public prosecution: It is so decided as per Disposition on the grounds of Article 327 subparagraph 6 of the Criminal Procedure Act or more.
