Defendant shall be punished by a fine not exceeding five hundred thousand won.

Where the defendant fails to pay the above fine, 50,000 won shall be one day.

피고인은 2013. 5. 2. 22:30경부터 22:35경까지 광주 서구 B에 있는 C파출소 주차장에 주차된 택시에서 술에 취하여 잠들었다가 경찰관인 피해자 D(남, 48세)으로부터 택시요금을 지불하고 귀가할 것을 권유받자 택시기사 E가 듣는 가운데 피해자에게 “이 지구대 새끼들 뭐야, 이 십할놈들, 에라 이 모지란 놈들, 콱 가만 안 둔다”라고 말하여 공연히 피해자를 모욕하였다.

As to the Defendant’s assertion of Article 334(1) of the Criminal Procedure Act, the Defendant alleged that he was in a state of mental disorder or mental disorder under the influence of alcohol at the time of committing the instant crime. Thus, according to the above evidence, even though the Defendant was found to have drank alcohol at the time of committing the instant crime, the Defendant did not have the ability to discern things or make decisions.

Inasmuch as it seems that it did not seem to have reached a state of or weakness, we cannot accept the above assertion.
