피고인은 2016. 1. 6. 02:20 경부터 같은 날 02:34 경까지 포항시 북구 B에 있는 ‘C 파출소 '에 술에 취해 찾아가서 그 곳에 대기 중이 던 경위 D에게 “ 내가 신고했다, 내한테 욕한 할매 데리고 와라, 짭새 새끼들, 아이 씨 발, 이 개새끼들, 저번에 내 음주 단속한 새끼들 어디 있노 ”라고 큰소리로 말하고, 오른 주먹으로 파출소에 설치된 탁자를 내리친 후, 머리로 파출소 출입문을 2번 들이 박는 등 약 14분 동안 소란을 피웠다.
