Reasons
Punishment of the crime
[2013 Highest 1498] The Defendants: (a) classified the Defendants into two incentives, one sales book, and one purchase book at each time in the call text, Kaba, etc. located across the country; and (b) recruited the victims at the pre-determined trading place; (c) recruited the victims of the pre-determined sales book and the pre-determined trading place; and (d) recruited the victims to receive a certain amount of money from the victims as if the victims paid the purchase price of the said drug, after the purchase of the drugs from the sales book, after the purchase of the drugs, such as Boxol, and Kaba, etc.; and (e) recruited the victims to receive the purchase price from the women, as if the victims paid the purchase price of the said drugs, by providing the corresponding medicine, and immediately inducing the victims to suffer sales profits.
1. Defendant A and B’s co-principal Defendants conspired with C and D on September 6, 2010 to the effect that, in collusion with C and D, Defendant B and C would allow the victim Q and R to left sales profits from the Stockholm injection, and that, as agreed in advance, sell the above medicine at KRW 3.9 million to D, a purchase book immediately after purchasing KRW 3.7 million from Defendant A, a sales book, as agreed in advance.
9.9.Around the same year, at the S coffee shop in the same Dong, the appearance of purchasing two Boxs in the above manner and making profits from selling 200,000 won per copy:

However, the Defendants, C, and D did not have any intention or ability to supply the corresponding goods even if they received the purchase price from the victims because they did not have the said drugs from the beginning at the time.
