피고인은 2014. 3. 1. 00:00경 업무로 B 그랜드 스타렉스 승용차를 운전하여 성남시 중원구 여수동에 있는 여수삼거리 도로를 야탑동 쪽에서 모란 쪽으로 시속 약 50km로 진행하게 되었는바, 그 곳은 전방에 신호등이 설치된 교차로가 있었고 당시 피고인은 같은 방향으로 앞서가는 피해자 C(62세) 운전의 D 쏘나타 택시의 뒤를 따라가게 되었으므로 이러한 경우 운전업무에 종사하는 사람에게는 그 동정을 잘 살피고 위 자동차가 정지할 경우 피할 수 있는 안전거리를 확보하고 진행하여야 할 업무상 주의의무가 있는데도, 졸음운전을 하여 이를 게을리 한 채 그대로 진행한 과실로 때마침 피고인 전방에서 신호 대기 중인 피해자 C 운전의 위 택시 뒷범퍼 부분을 피고인 운전의 위 스타렉스 승용차의 앞부분으로 충격하고, 그 충격에 밀린 피해자 C 운전의 위 택시가 앞으로 밀리면서 신호 대기 중이던 피해자 E(32세) 운전의 F 벤츠 승용차의 뒷범퍼 부분을 충격하게 하고, 계속하여 피해자 C 운전의 택시가 위와 같은 충격으로 인해 좌측으로 튕겨나가면서 좌측 앞범퍼 부분으로 맞은 편 도로를 모란 쪽에서 야탑동 쪽으로 진행하는 피해자 G(56세) 운전의 H 쏘나타 택시의 좌측 뒷범퍼 부분을 연쇄 추돌하게 하였다.
