A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On June 4, 2019, the Defendant: (a) around 22:00, the Defendant, while under the influence of alcohol in front of the funeral hall D of C Hospital C Hospital D, Busan, the Defendant: (b) went to the funeral hall without any justifiable reason; (c) went to the funeral hall; and (d) took the victim E (the age of 27)’s departure from the funeral hall; and (d) took the head of the Defendant’s departure from the funeral hall; and (e) took the head of the victim E (the age of 27) taking the head of the Gu’s escape

2. 공무집행방해 피고인은 같은 날 22:25경 같은 장소에서 ‘난동을 부리는 사람이 있다’는 112신고를 받고 출동한 사상경찰서 F지구대 소속 경장 G으로부터 “장례식장에는 어떻게 왔는지, 아는 사람이 있는지” 등 사건경위 파악에 대한 질문을 받자 양 손목을 내밀며 “수갑 채워라, 잡아가라”라고 하고 갑자기 위 G의 멱살을 잡아 벽쪽으로 밀치고, 계속하여 장례식장 입구 앞 노상에서 공무집행방해로 현행범인체포하여 순찰차에 태우기 위해 수갑을 뒤로 채우려는 같은 소속 경위 H의 낭심과 허벅지 부위를 발로 차고, 위 G의 왼쪽 정강이 부위를 5회 가량 발로 찼다.

Accordingly, the defendant interfered with the legitimate execution of duties by police officers on handling 112 reported cases and arrest of flagrant offenders.
