A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On December 27, 2012, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (thief) at the Dong Branch District Court of Seoul, and for a crime of fraud, etc. on March 30, 2014, and the execution of the sentence was terminated by the lawsuit against the first intersection of the North Korean Branch on March 30, 2014.

1. On September 15, 2006, the Defendant was sentenced to one year of imprisonment with prison labor for night intrusion larceny, etc. at the Seoul Eastern District Court on the 23th day of the same month. On April 8, 2009, the Seoul Central District Court was sentenced to one year and two months of imprisonment with prison labor for larceny, etc. on the 14th day of the same month. On November 18, 2010, the said judgment became final and conclusive on the 26th day of the same month upon being sentenced to eight months of imprisonment with prison labor for larceny at the Seoul Central District Court for the crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes as stated in the record of the said repeated crime.

On October 24, 2015, the Defendant: (a) reported on around 02:30,000 won of cash, driving license, card, etc. owned by the victim C, who was under the influence of the victim C before the department stores 357-1 NC department stores in the field of the night tower; and (b) accessed the victim; and (c) 100,000 won of the market price in which the victim’s cash, driving license, card, etc. are included; (d) and (e) 400,000 won of the market price.

2. Embezzlements of deserted articles in possession;

A. On September 19, 2015, the Defendant, on September 19, 2015, embezzled for possession: (a) around 05:00 on September 19, 2015, found the instant cell phone so far as he/she had lost the victim D at the bus stops located in 439, Songpa-gu Seoul, Songpa-gu, Seoul.

Defendant 1 did not take necessary procedures such as returning the above acquired property to the victim, but did so.

Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.

B. On October 24, 2015, the Defendant’s embezzlement of the deserted articles in possession around 02:20 on October 24, 2015 is Sungnam-si, Sungnam-si, around October 24, 2015.
