Punishment of the crime
"2018 Highest 132"
1. Around 18:00 on December 5, 2017, the Defendant made a false statement to the effect that “A” heading “D” heading “D” heading “D” heading “D,” the owner of E, would immediately board the victim B as a seafarer on the following day.”
However, in fact, the defendant received advance payment from the victim and intended to use it for personal living expenses, such as entertainment expenses, and there was no intention to board the ship as a seafarer.
Around 18:40 on the same day, the Defendant, by deceiving the victim as such, received KRW 3,800,000 from the Suhyup Bank Account (F) under the name of the Defendant, for advance payment.
2. Around 11:00 on December 28, 2017, the Defendant against the victim G made a false statement to the effect that “I will get the victim G, the vessel owner of J, to work on board as a seafarer from January 10 to December 2018, 2018,” which read “I will get the victim G, the vessel owner of J, to work.”
However, in fact, the defendant received advance payment from the victim and intended to use it for personal living expenses, such as entertainment expenses, and there was no intention to board the ship as a seafarer.
As such, the Defendant was issued 10,000,000 won (one million won's cashier's checks) under the name of advance payment from the victim by deceiving the victim as such, that is, from the victim.
Accordingly, the defendant was informed of the victims and received property twice.
"2018 Highest 1397"
1. On May 23, 2018, the Defendant committed the crime of May 23, 2018, concluded a false statement to the effect that “The Defendant would have the victim N, the owner of “M” in the “LDak” located in Seocheon-gun, Seocheon-gun, Chungcheongnam-gun, for the purpose of “M, on board the ship as a seafarer from June 10, 2018 to M”.
However, the defendant was an intention to use it in the name of personal living expenses, such as living expenses of female-friendly households living together with the victim, and he/she was on board the ship as a seafarer.
