1. Basic facts

A. On May 31, 2012, the Defendant: (a) leased the Plaintiff with a lease deposit of KRW 20 million (payment of KRW 2 million on May 31, 2012; (b) KRW 1.3 million per month of rent; (c) KRW 13 million per month of rent; and (d) from June 25, 2012 to June 30, 2014, the lease term of KRW 34.2 square meters (hereinafter “instant real estate”).

Although the Plaintiff paid the down payment of KRW 2 million on the date of the instant lease agreement, the remainder of the deposit was not paid until June 25, 2012. The Defendant urged several remaining payments, and sent a document to the Plaintiff on August 2, 2012, stating that the instant lease agreement was terminated on the grounds that the remainder was unpaid, and the document reached the Plaintiff around that time.

C. As to this, the Plaintiff’s mother D promised to pay to the Defendant the remainder of the deposit amount of KRW 18 million by September 10, 2012. In the event of nonperformance of the promise, the Plaintiff voluntarily decided to deliver the instant real estate to the Defendant by September 17, 2012, but the Plaintiff did not pay the remainder of the deposit amount of KRW 18 million to the Plaintiff even on September 10, 2012.

On September 12, 2012, the Defendant filed a lawsuit against the Plaintiff seeking delivery and overdue rent of the instant real estate by Seoul Central District Court 2012Gahap77636.

On August 23, 2012, a temporary deposit of KRW 1430,00 won on September 20, 2012, a deposit of KRW 200,000 won on September 20, 2012, and KRW 25,10,000 on October 25, 2012, a deposit of KRW 1430,00 won on October 31, 2012, a deposit of KRW 1433,00 won on November 27, 2012, a deposit of KRW 143,00 won on December 31, 2012, a deposit of KRW 143,00 won on March 31, 2013, a deposit of KRW 430,000 on March 15, 2013; and a deposit of KRW 130,000,00 on the title of KRW 1361,213.261.261.

E. As to the instant lease agreement, the Plaintiff’s deposit and the Defendant until June 21, 2013 after the Defendant’s notice of termination was given.
