Examining the evidence duly admitted by the first instance court, which maintained the reasoning of the lower court, the lower court was justifiable to have maintained the first instance judgment convicting the Defendant of the instant facts charged (excluding the portion without charge) on the grounds stated in its reasoning.

In so doing, contrary to the allegations in the grounds of appeal, there were no errors by misapprehending the legal principles regarding the requirements for recognizing a crime different from the facts charged without any changes in the indictment, whether a person commits deception or fraud in fraud, and the meaning of the exercise in the crime of deception in the above investigation document, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
