Reasons
1. Basic facts
A. D is the Plaintiff’s husband, Defendant B is the Plaintiff’s husband, Defendant E’s punishment, and Defendant C’s punishment (F).
B. On March 2, 2008, E entered into a sales contract with G, H, I, J, K, L, and M (hereinafter “G, etc.”) with the content that he/she shall purchase at KRW 22,90 square meters of the total of 36,542 square meters of N farm site and KRW 17,789 square meters of O forest land (hereinafter “AB land”) from G, etc. and KRW 150,000 of the sales price, KRW 140,000 of the sales price, KRW 140,000 of the down payment, and KRW 140,000 of the down payment (hereinafter “the first sales contract”).
C. On April 10, 2008, D lent to E 150,000, 30% per annum, 30% per annum, and 150,000,000 due date on September 10, 2008. E. On January 16, 2010, E and the Plaintiff entered into a real estate sale and development contract with respect to P land as follows. On January 22, 2010, the Plaintiff paid 100,000 won as down payment to E.
【Contents of contract】 ① The Plaintiff deposited KRW 100,000,000 in the account of E by January 22, 2010.
② E shall obtain all authorization and permission necessary for developing P land under the Plaintiff’s name as an industrial site on June 2010. If E fails to obtain such authorization and permission, this contract becomes null and void and the down payment shall be refunded to the Plaintiff immediately.
③ The Plaintiff shall pay Qua, etc. a balance of KRW 400,000,000 for the purchase and sale of P land within one month from the date of authorization and permission under the preceding paragraph.
E shall complete the registration of ownership transfer of P land from Q, etc. in the future of the plaintiff.
