1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. Under the National Sports Promotion Act, the Korea Sports Council was established with authorization from the Minister of Culture, Sports and Tourism in order to support the business and activities of the affiliated sports organizations. The Korea Sports Council was incorporated with the Korean Sport Association, which is a private sports organization for similar purposes (amended by Act No. 13246, Mar. 27, 2015). In the process, the integration between the Jeju Special Self-Governing Province Branch affiliated with the Korea Sports Council and the Jeju Special Self-Governing Province Sports Association, which is a member of the Korean Sport Association. 2) Accordingly, the integration of each organization was promoted in Category B, and the Jeju Special Self-Governing Province B Association and the Jeju Special Self-Governing Province Sports Association (hereinafter “Do Association”) (hereinafter “Do Association”) (hereinafter “B Association”), around July 2016.
3) In the Do Association B and Do Association B, respectively, recommended 20 representatives respectively (in the case of the Do Association B, 8 representatives in their own organization, 7 representatives in Jeju-si SportsB Federation (hereinafter “ Jeju-si Federation”) as its affiliated organization, and 5 representatives in the Seopo-si SportsB Federation (hereinafter “Seopo-si Federation”), respectively.
[2] On August 21, 2016, the Defendant’s inaugural general meeting was held while 40 representatives recommended as above were present. 4) The Plaintiff and C were present as candidates for the election of the president conducted at the above inaugural general meeting by the Plaintiff and C. As a result of the representative voting, C was elected as chairperson by obtaining 12 votes and 28 votes.
B. On April 14, 2016, the 1Do Do Do 2 federation was held at an ordinary general meeting of representatives and held with B Association in the presence of representatives from April 14, 2016.
