2. Determination as to the cause of action
A. The gist of the plaintiffs' assertion 1) The registration of ownership transfer in the name of the deceased and his heir, who acquired ownership of the land of this case without completing the registration, was negligent in managing the land of this case. Since the registration of ownership transfer in the name of the primary defendant, which was made based on the above invalidation registration, is null and void, the primary defendant is liable to implement the registration procedure for ownership transfer based on the restoration of real name as to the land of this case against the plaintiffs, who are the heir of the deceased K. (2) The primary defendant, who violated the procedure for the first preliminary claim for confirmation of the completion of agreement as stipulated in the relevant Acts and subordinate statutes in the course of the consultation acquisition of the land of this case, thereby causing losses to the plaintiffs who lost their right to claim ownership or ownership transfer registration as a result of the violation of the procedure for the first preliminary claim for confirmation of ownership transfer as to the land of this case. The primary defendant is liable to pay compensation to the plaintiffs as a tort.
