A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 4, 2020, the Defendant: (a) around 01:10 on March 4, 2020, at Cju stores located in Sejong City B, as a vision for not paying the victim’s singinging and singing, and (b) taken the victim’s bucks several times on the floor of hand; (c) taken the victim’s right buckbucks, walking the victim’s right bucks; and (d) taken the victim’s single radio microphone, which is a dangerous object,

While recognizing the instant crime, the Defendant and the defense counsel asserted to the effect that the Defendant did not walk the victim’s right buckbucks, and did not go to the victim more than twice in wireless microphones.

이 법원이 적법하게 채택하여 조사한 증거에 의하면, 피해자는 수사기관에서 “피고인이 오른쪽 허벅지를 걷어찼고, 무선 마이크로 2회 내리쳐서 1회는 머리 부위에, 1회는 팔 부위에 맞았다.”라는 취지로 구체적으로 진술한 점, 이 사건 범행 직후 피해자의 머리, 팔, 허벅지 부위를 찍은 사진에는 피고인으로부터 맞아서 생긴 상처, 멍 등이 찍혀 있는 점(증거기록 12~14면), 피고인도 수사기관에서 마이크로 2회 때린 사실은 인정하는 진술을 하였던 점(증거기록 31면) 등의 사정들이 인정되고, 이를 종합하면 피고인은 공소사실과 같이 피해자의 오른쪽 허벅지를 걷어차고, 무선 마이크로 2회 내리친 사실이 충분히 인정된다.

As a result, the defendant carried dangerous things with the victim for about 14 days and inflicted multiple injuries upon the victim in need of treatment.
