The plaintiff filed a payment order (Seoul Central District Court 2009 tea 48578) that "3,00,000 won against the defendant and damages for delay at the rate of 20% per annum from the day following the service of the original copy of the payment order to the day of complete payment," and the plaintiff received the payment order around May 6, 2009, which became final and conclusive on May 27, 2009.

The plaintiff filed the lawsuit of this case for the extension of extinctive prescription against the above payment order.
