1. All plaintiffs' lawsuits are dismissed.

2. The costs of lawsuit are assessed against the plaintiffs.

1. Basic facts

A. On December 1, 2015, Plaintiff A leased KRW 30,00,00, and KRW 60,000, and the lease term from December 1, 2015 to November 30, 2017, among the buildings listed in the attached list No. 3 from E. 1, 2015.

Plaintiff

A has been living in India and completed the resident registration on March 3, 2016.

B. On September 2014, Plaintiff B leased a part of 50 square meters of a single-story house, among the buildings listed in the attached Table No. 3 of the attached Table No. 3, from early September 2014, the lease deposit amount of KRW 38,00,000, and the lease period of KRW 50,000, from early September 2014 to early around September 2015.

Plaintiff

B has resided in India around that time, and completed resident registration on September 11, 2014.

After that, on November 15, 2015, Plaintiff B concluded the lease term of the said lease agreement with E from November 20, 2015 to November 20, 2017.

C. On April 15, 2016, on each real estate listed in the separate sheet, the Suwon District Court rendered a decision of compulsory commencement of auction by force to Suwon District Court Branch C (hereinafter “instant auction procedure”), and on the 18th of the same month, the entry registration was completed regarding each of the above real estate.

On April 21, 2016, the above auction court decided on June 27, 2016 as the type of demand for distribution of the auction procedure of this case.

On the other hand, on November 23, 2016, the decision to voluntarily commence the auction was rendered on each real estate listed in the separate sheet D, and on the 24th of the same month, the entry registration was completed.

E. On January 4, 2017, an auction court issued an order for sale determined as of January 31, 2017, the date of the collective sale and the date of sale under the auction procedure, March 28, 2017; April 25, 2017; and on May 2, 2017, the date of the decision for sale; and on May 2, 2017, the auction court issued an order for sale to F and G on May 2, 2017.

F. On May 4, 2017, after the completion date of the demand for distribution, Plaintiff A filed a report on the right to return the lease deposit claim under the lease agreement set forth in Article 1(a) with the auction court and filed an application for demand for distribution.

After that, Plaintiff B also on May 2017.
