The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for two years.
The defendant shall obtain money from the applicant C to the applicant C 5,180.
Reasons
1. The summary of the grounds for appeal (unfair sentencing) of the lower court’s punishment (two years of imprisonment with prison labor) is too unreasonable.
2. An ex officio prosecutor filed an application for changes in indictment with the purport to withdraw part of the facts charged in the second trial of this Court No. 2017 order No. 2046, 2017 order No. 3189.
The judgment of the court is no longer able to maintain as long as the subject of the judgment is changed by permitting the modification of the bill of amendment.
3. The judgment of the court below is reversed in accordance with Article 364(2) of the Criminal Procedure Act, without examining the defendant's improper assertion of sentencing, and the judgment of the court below is reversed and it is again decided as follows.
