1. The Defendant’s KRW 194,569,453 as well as the Plaintiff’s annual rate from October 28, 2014 to April 16, 2015.

1. Basic facts

A. On March 20, 2013, the Plaintiff, a holder of solar power generation project, entered into a construction contract with Ebertech, Inc. (hereinafter “Ebertech”) to construct a 500 KW solar solar power plant (hereinafter “instant electric power plant”) by April 30, 2013 on the land A, B, and C in Ebertech.

Along-to-Energy Co., Ltd. (hereinafter referred to as “accuracy”) was awarded a subcontract for the instant power plant construction work under the name of Sung-Tech Engineering Co., Ltd., an affiliate company, on March 20, 2013.

B.1) On April 29, 2013, the Plaintiff, who was planning to pay the said construction cost through the project financing (PF) loan, drafted a “Special Agreement on Construction of Esolar-Power Power Plants” with the following contents as the maximum energy on April 29, 2013. [1] In connection with the instant electric power plant construction project, KRW 250 million shall be taken in advance by the Plaintiff, and the remainder shall be paid to the amount of KRW 950 million out of the remainder; hereinafter the same shall apply] / [2] When the Plaintiff was unable to engage in the electric power generation business due to any cause attributable to the Plaintiff and the landowner during the instant electric power plant construction project, the Plaintiff transferred the power generation right to the Plaintiff until the amount of the construction cost (6% per annum) is recovered, and the amount of the Plaintiff’s additional energy upon the request of the Plaintiff [30 million won prior to the completion of the construction project], and the amount of the Plaintiff’s installation and electric power plant installation expenses shall be paid to the Plaintiff and the Plaintiff’s installation installation installation expenses at the same time.
