A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

피고인은 2013. 5. 2. 04:00경 삼척시 C에 있는 ‘D 식당’ 내에서 피해자 E(23세)가 안부전화를 하지 않고 전화도 받지 않는다는 이유로 피해자의 뺨을 오른 손바닥으로 1회 때린 다음, 위 식당 바깥으로 불러내어 피해자의 뺨을 손바닥으로 15회 때리고, 피고인 소유의 F SM7 승용차에 태워 같은 시 G빌라 뒤편 차도에 차량을 세우고 피해자를 내리게 한 다음, 피해자의 머리채를 한 손으로 잡고 위 식당에서 가지고 온 위험한 물건인 가위를 손에 들고 3~4회 피해자의 배 부위를 찌를 듯이 위협하고, 재차 피해자의 뺨을 주먹으로 1회 때린 후, 도로변에 있던 위험한 물건인 돌(13cmX10cmX8cm)을 오른손에 들고 피해자의 머리와 목 부위를 2-3회 내리치고, 다시 피해자의 뺨을 손바닥과 주먹으로 15회 때리고 난 후 발로 가슴과 정강이를 걷어찼다.
