1. The defendant (appointed party)'s appeal is dismissed.
2. After filing an appeal, the total costs of the lawsuit are assessed against the Defendant (Appointed Party).
Reasons
. Based on the contractual relationship with the DA succeeding to the existing contract, each party occupies and uses his store until now;
(2) As to the buildings listed in the separate sheet No. 2 list, in the compulsory auction procedure requested by the Plaintiff A, etc., DA acquired ownership by fully paying the sale price on September 3, 2010, but thereafter DDR acquired ownership by fully paying the sale price after receiving a successful bid in the compulsory auction procedure on March 19, 2015.
C. As the deceased’s co-ownership rights are acquired and changed (1) the deceased’s co-ownership rights are deceased on April 9, 1982, the deceased’s inheritors completed the registration of ownership transfer according to their respective inheritance shares as follows with respect to the instant land:
Child of the Sea Transport DH (Death on July 12, 1954): 18/132 - Z: 12/132 of ASEAN, BZ, CR, Plaintiff A: 12/132 of each of 12/132 - Mart, CU: 3/132 of 3/132 of each of 3/1322, and 12/132 of ASEAN, Plaintiff C: 12/132 of 12/132 of ASEAN (Death on December 19, 1986): The husband’s husband’s children D, E: 1/132 of each of 1/132 shares - The shares of Q 1/132 of 32/130 of the current status of shares transferred to CJ 213/132 of the CJ - The shares of 32/132/132 of the deceased shares of 32/120 of the CJ 21321/131/6.
However, on March 26, 2014, Plaintiff A acquired ownership of each of the above shares by obtaining a successful bid of 406/664/6000 shares, Plaintiff B’s 72534/6000 shares, Plaintiff C’s 48384/66000 shares, Plaintiff E’s 4032/66000 shares, and DA’s 21764/6000 shares for each purchase price in full.
(B) CY Co., Ltd. (hereinafter “CY”) received each gift from CY on August 17, 2010, 18/132 of its respective shares, and 12/132 of their respective shares from CP and CR, and completed the registration of transfer. DA is between CY’s shares on November 15, 2013 and BY’s shares.
