1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The defendant's words as the party's status C is the owner of the registry of the 8th floor accommodation of the D-ground reinforced concrete structure in the Gu's Government-si as a Korean national residing in the Brasi City of Brazil, and the defendant is the person who actually manages the instant Moel.
B. On March 13, 2013, the Defendant concluded a lease agreement and set up a right to collateral security (hereinafter “instant lease agreement”) with C’s agent, stating that the instant Maurel shall be leased KRW 1,200,000,000, monthly rent of KRW 28,000,000 (hereinafter “instant lease agreement”).
(2) According to the special agreement, the Plaintiff issued a receipt for KRW 60,000,00, which was remitted to the Plaintiff on March 13, 2013 (=60,000,000, which was remitted to the Plaintiff on March 13, 2013) under the name of the Plaintiff, and issued a receipt for KRW 60,000,00,000, which was remitted to the Plaintiff on March 13, 2013, to the Plaintiff on KRW 40,000,00, which was remitted to the Plaintiff on March 13, 2013, to KRW 60,000,00, which was remitted to the Plaintiff on March 13, 2013.
3) At the time of the conclusion of the instant lease agreement, the establishment registration of a neighboring mortgage under the name of the National Bank, Co., Ltd., Ltd., the maximum debt amount of which was KRW 3,770,000,000, and the amount of KRW 650,000,000, was completed. However, following the Plaintiff’s payment of the intermediate payment as above, the establishment registration of a neighboring mortgage under the name of the Plaintiff (hereinafter “mortgage-mortgage-mortgage-backed security”) was completed in accordance with the special agreement stipulated under the instant lease agreement on March 25, 2013, which was subsequent to the payment of the intermediate payment.
C. The dispute occurred. C. The plaintiff and the defendant concluded the instant lease agreement, and the Moel building of this case was aging and guest rooms.
