The defendant's appeal is dismissed.
Reasons
1. The summary of the grounds for appeal: (a) the Defendant has been engaged in the transaction with the victim for about 20 years; (b) there was no problem in the process; and (c) it is difficult to conclude that there was a criminal intent to commit fraud only because the Defendant was unable to pay the construction cost inevitably due to disputes with the ordering person; (b) the Defendant was awarded a subcontract to the victim by obtaining a contract from the ordering person; and (c) the Defendant was forced to pay the construction cost to the victim inevitably due to disputes arising in connection with the payment of the construction cost; and (d) the Defendant was making efforts to pay to the victim by helping the victim issue a tax invoice; and (d) the Defendant agreed with the victim and continued transaction relationship with the victim even after the pronouncement of the lower judgment, and thus, the Defendant did not have any intent to obtain fraud; and therefore, there was an error of
2. Determination
A. The summary of the facts charged of this case (1) on August 2009, the Defendant acquired financial benefits equivalent to the same amount as the Defendant did not pay for the said amount because it stated that the Defendant did not have any intent or ability to pay for the said amount even if it was requested for the manufacture and installation of the 3 and 4 stories of the Seo-gu D Building in the Seoul Special Metropolitan City (Seoul Special Metropolitan City) in the construction site, the fourth floor, and that the Defendant would make and install the said scams, etc. over a month between the victims who believed to be true, even though they did not pay for the said amount.
(2) On April 27, 2010, the Defendant found the case in Gju room operated by the said victim at Pyeongtaek-si F, even though he did not have the intent or ability to pay the price even if he requested for the manufacture and installation of singing and singinginging, the Defendant assembled the first floor in Pyeongtaek-si H.
