1. The Plaintiff, Defendant B Co., Ltd., and Defendant C, as well as Defendant C’s KRW 215,876,063, and each of them on July 18, 2015.
Reasons
1. Basic facts
A. The relevant Plaintiff of the parties is a company aimed at the business of wholesale and manufacturing, etc. of painting equipment, and Defendant B Co., Ltd. (hereinafter “Defendant Company”) is a company aimed at the business of manufacturing diversating machines, etc., and Defendant C is a representative director of the Defendant Company, and Defendant C is a representative director of the Defendant Company, and the “D” is a person engaged in the business
B. On January 16, 2015, the Plaintiff entered into a contract for construction works between the Plaintiff and the Defendant Company (hereinafter “instant subdivision facility”).
(i)the primary construction works (hereinafter referred to as “the primary construction works”) are produced and installed;
(2) A contract for construction works (including value added tax) with the term of KRW 935 million and the term of March 1, 2015 to March 30, 2015 (hereinafter “the first contract”) to which the contract is made (hereinafter “the first contract”).
The primary contract is concluded. The main contents of the primary contract are as follows. Article 1 (Name of Equipment: Contract: Contract Name of Subdivision Facility: Article 2 (Contractor): The Plaintiff and the Defendant Company order the Defendant Company A to “B” with respect to the contract for the supply of equipment and conclude the following contract for painting equipment by ordering the Plaintiff to “B” and ordering the Plaintiff to “B”. Article 3 (Contract Amount): Not more than KRW 850,000,00-) daily gold KRW (850,000,00-) and Article 4 (Contract Date): General Matters concerning the Contract - (Payment Terms and Conditions of Cash Settlement) (1) of Article 6 (Payment Terms and Conditions of Cash Settlement): Within 30 million won after the completion of the contract: Within 150,000,000 won after the completion of the contract: Within 300,000,000 won after the expiration of the contract.
(2) The installation of equipment is a newly built factory E located in Ulsan-gun, Ulsan-si, from March 1, 2015 to Ulsan-si.
