1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff is the wife of the deceased B (hereinafter “the deceased”).
B. On June 1, 199, the Deceased was appointed as a elementary school teacher and died in the heart color as of March 1, 2008, when he worked as a teacher at C elementary school from March 1, 2008.
C. On February 28, 2013, the Plaintiff filed an application for registration of a person who has rendered distinguished services to the State or a person eligible for veteran’s compensation with excessive stress caused by the Deceased’s excessive performance of duties, and died of heart diseases. However, on November 4, 2013, the Defendant did not confirm objective evidence that the Deceased died as a direct cause of duties or education and training directly related to the protection of the life and property of the people, and did not constitute the requirements for public officials who died on duty as prescribed by the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Services to the State, and on the ground that, considering the medical information about heart diseases, it does not constitute the requirements for proximate causal relation between the Deceased’s death and the deceased’s performance of duties or education and training as prescribed by the Act on the Support for Persons Eligible for Veteran’s Compensation, on the ground that it does not constitute a public official in charge of providing distinguished services to the State and a person eligible for veteran’s compensation.
The Plaintiff filed the instant lawsuit against the instant disposition without going through the previous trial procedure.
