1. Defendant Safety Taxi Partnership Company: 16,855 won to Plaintiff A, 142,372 won to Plaintiff B, and Defendant Dae-il Transport.

Reasons

1. Facts of recognition;

A. The Defendants are general taxi transport business operators who employ general taxi drivers and are engaged in passenger transport business under Article 2 subparag. 3 of the Passenger Transport Service Act (hereinafter “passenger Transport Service Act”). Plaintiffs A, B, and Plaintiff C are the taxi drivers of Defendant Safety Taxi Partnership (hereinafter “Defendant Safety Taxi”), and Plaintiff C, respectively.

B. On September 3, 2009, the Defendants, the Daegu Passenger Transport Business Association, and the Daegu Regional Headquarters of the Korea Taxi Industry Workers’ Union (the National Taxi Trade Union) agreed to pay 40% of the reduced or exempted tax amount (42,000 won) in addition to 50% (58,000 won) of the reduced or exempted tax amount (42,00 won) already paid through a collective agreement or wage agreement on September 3, 2009, including the wage. On May 23, 2013, the Plaintiff agreed to pay the reduced or exempted tax amount of 120,000 won including the reduced or exempted tax amount of 120,000 won in wage.

(c) The main contents of a collective agreement and a wage agreement concerning working hours and wages are as follows:

1) 근로시간 및 기본급 지급 2011년의 근로시간은 1일 6⅔시간, 1주일 40시간이고(제16조), 기본급은 6⅔시간을 기준으로 산정(주휴수당 포함)되었는데(제38조), 2013. 5. 23.자 노사합의로 2013. 6. 1.부터는 기본급은 1일 6시간을 기준으로 산정되는 것으로 변경되었다. 2) 임금 가) 임금체계 : 조합원(운전기사) 임금체계는 정기급여(기본급, 제수당, 연장 근로수당, 성실수당, 휴일근로수당, 성과급[업적급])와 상여금 및 기타 복리 후생적 급여로 한다(제34조). 나) 임금의 구분 : 임금은 기본급, 근속급, 승무급, 성과급(업적급), 성실수당, 야간근로수당, 연장근로수당, 휴일근로수당으로 한다

(Article 35(c) Allowances: Continuous allowances, work allowances, night work allowances, overtime work allowances, and other allowances for continuous service.
