A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[Criminal Power] On March 28, 2014, the Defendant was sentenced to two years of suspension of the execution on April 5, 2014 by the Seoul Southern District Court for the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, etc. (Dokju).

【Criminal Facts】

1. Around 10:10 on January 16, 2015, the Defendant driven a E-Ad vehicle in the name of D in the section of approximately 300 meters from the road located in the 367-10, Seocheon-gu, Seocheon-gu, Seocheon-si, Seoul, without a driver’s license.

2. On January 26, 2015, the Defendant, while under the influence of alcohol with blood alcohol content of 0.094% without a driver’s license on January 26, 2015, operated GPool vehicle leased by the Defendant from the road located in the Hancheon-si, Seocheon-si, Seocheon-si to the public parking lot in Seocheon-si, Seocheon-si, Seocheon-si, Seocheon-si, Seocheon-si, 482 to the public parking lot in Seocheon-do.

3. On January 27, 2015, the Defendant: (a) at the Defendant’s house located in Seocheon-gu, Seocheon-gu, Seocheon-si F, the Defendant stated that he was driving at the police station in order to conceal his drinking driving under the above paragraph (2); and (b) told Ha to make a false statement.

Therefore, the Defendant made the said H false statement to the effect that, around January 27, 2015, the Defendant was driving the investigating police officer I at the office of the transportation survey department of the Busan High Police Station located in Seocheon-si, Seocheon-si, Seocheon-si.

Accordingly, the Defendant instigated the above H to escape a person who committed a crime corresponding to a fine or heavier punishment.
