피고인은 2015. 10. 15. 14:40경부터 17:14경까지 의왕시 C에 있는 피해자 D이 운영하는 ‘E 한의원’ 앞 도로에서, ‘F’ 회원 20여명과 함께 건물 권리금 문제로 피해자를 향해 시위를 하면서 위 한의원 현관문을 세차게 흔들면서 “문 열어라, 내가 누구인 줄 아냐, 왜 문을 안 여냐, 내가 누구인 줄 아냐”라고 큰소리치고, “어머나, 어머나 이러지 마세요. 건물주 마음은 갈대랍니다. 안돼요! 왜 이래요! 내쫓지 말아요! 돈 때문에 이러시면 안돼요. 월세 내고 빌린 가게이지만 내 삶터인걸요. 잘못된 법 바꿨는데 왜 쫓아내려 해요. 나의 삶터 지킬거야, 주고 살아도 뺏기지 않을 거야. 우리가게! 우리 권리! 함께 지켜가며 장사할래. 맘 편하게 장사하자. 탐욕을 버리고 함께 살자!”라고 가수 G의 ‘어머나’ 노래를 개사하여 확성기를 통해 합창하는 등의 방법으로 그 한의원에 들어오려던 손님들이 들어오지 못하게 하여 위력으로써 피해자의 한의원 영업 업무를 방해하였다.
