The defendant's appeal is dismissed.

1. The summary of the grounds for appeal (defendants) by the lower court is too unreasonable.

2. The judgment is an unfavorable situation where the Defendant, without experience of successful completion of installation works of solar power plants, by deceiving the victim to install a solar power plant and take it over to the victim, and the case of the instant crime that acquired 40 million won by deceiving the victim, most of the money that the Defendant acquired from the victim was used as operating expenses of the Defendant company, and most of the money used for installation works of solar power plants seems to have never been lost, damage caused by the instant crime is rarely recovered, and there are several records of criminal punishment against the Defendant.

On the other hand, there are favorable circumstances such as the fact that the defendant reflects the wrong, that the criminal record of the defendant was sentenced to a fine, and that the defendant has no criminal power after 201.

In full view of such circumstances and all of the sentencing conditions as shown in the instant argument and the scope of the recommended sentencing guidelines, the lower court’s sentence cannot be deemed to be too unreasonable.

3. As such, the defendant's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that the defendant's appeal is groundless.
