1. As to KRW 334,254,572 and KRW 239,744,572 among the Plaintiff, the Defendant shall start from December 12, 2017 to March 26, 2018.
Reasons
1. Basic facts
A. The Defendant is the “project owner” as prescribed by the Fair Transactions in Subcontracting Act (hereinafter “subcontract”) with respect to the construction of the Dokdo Volunteer Defense Team Memorial (hereinafter “instant headquarters”)
Jinjin Construction Co., Ltd. (hereinafter referred to as “Dinjin Construction”) is a “original contractor” under the Subcontract Act that was awarded a contract by the Defendant for the instant original construction, and the Plaintiff is a subcontractor under the Subcontract Act who subcontracted the construction of water supply and structures (hereinafter referred to as “instant construction”) during the instant original construction from Jinjin Construction.
B. On September 30, 2015, the Plaintiff and Jinjin Construction concluded a subcontract with the construction period from October 1, 2015 to June 22, 2016 (hereinafter “instant contract”; the construction price and the construction period of the instant contract were KRW 902,00,00 (including value-added tax; hereinafter the construction price includes value-added tax, barring any special reference).
The original contract amount for the construction of waterworks and structures from September 22, 2014 to July 31, 2017, among the construction works of the Dokdo volunteer Defense Team under the original contract amount: the original contract amount of KRW 300 million (including value-added tax 1,178,000,000) per day (including value-added tax) for the construction works of the Dokdo Volunteer Defense Team under the name of the construction works: the original contract amount of KRW 7,860,122,000 (including value-added tax) for the construction of the Dokdo Volunteer Defense Team under the contract amount: the amount of KRW 300,000,000 won per day (including value-added tax 1,78,000,000 won per day): the first contract period of KRW 30,000,000 won per day (including value-added tax): the amendment of KRW 300,000,000 won per day on October 1, 2015 to June 22, 3016.
