A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On August 12, 2016, the Defendant driven a motor vehicle from around 500 meters away from around 22:00 to around 315, 146, a 500-day road in Suwon-si, the number of 16:35 Sinwon-si, the Defendant used the motor vehicle from around 16:5 to the 315-day road, without obtaining a driver’s license.

The grounds for sentencing under Article 62-2 of the Criminal Act, comprehensively taking into account the following circumstances and the Defendant’s age, family relation, sex, environment, motive and background of the crime, means and method of the crime, and the circumstances after the crime, etc., the punishment as ordered shall be determined.

[The favorable circumstances] The defendant acknowledged his mistake while leading to the confession of the crime of this case; the defendant did not cause other damage, such as traffic accidents, etc. at the time of this case; and the defendant has no record of criminal punishment exceeding the fine.

[Unfavorable Circumstances] The crime of this case is a matter of driving a vehicle without a driver's license and the quality of the crime is not good, and the defendant has been sentenced to eight times a fine due to a violation of the Road Traffic Act (drinking) and a violation of the Road Traffic Act (licensed driving).
