Defendant shall be punished by a fine of KRW 3,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

4. 16.경까지 사이에 군포시 C에 있는 피고인의 집에서, 컴퓨터를 사용하여 아이디 ‘D’로 P2P방식의 인터넷 파일공유사이트인 ‘파일구리(fileguri.com)’에 ‘13살 아다 때임’, ‘고등학생’, ‘고딩들 가슴큰 내여친1 - 오빠 박아죠!!!’, ‘지나가던 초등학생 차에태워’, ‘초등학생 스타킹 찢고’라는 제목으로 아동청소년인 어린 여성이 남자와 함께 성기를 노출한 채 성교행위 등을 하는 내용의 동영상 5편을 게재하여 불특정 다수의 회원들이 이를 다운로드받아 시청할 수 있도록 하였다.

Accordingly, the Defendant distributed or openly displayed child or juvenile pornography.

The Defendant, etc. of the Act on Promotion, etc. of Information and Communications Network Utilization and Information Protection (Distribution of obscenity) posted 83 copies of video images containing sexual intercourse with the exposure of male and female sexual organ to the date, time, place, etc. set forth in the foregoing paragraph (1) and the said method, i.e., “the said method” (hereinafter “the said method”).

Accordingly, the Defendant distributed or displayed obscene videos to the public through information and communications networks.
