B 주식회사는 서울 종로구 C에서 토목건축공사업 등을 영위하는 법인으로 2008. 11. 19.부터 실시된 전북 순창군 D 소재 E 확장공사(2공구)의 시공사이고, 피고인 A는 위 회사 소속으로 위 공사의 현장소장으로 안전보건총괄책임자이다.

1. Defendant A

(a) A business owner who has violated the Occupational Safety and Health Act on January 11, 2014 shall use vehicle meters only for the principal use of the machinery, and shall not allow workers to enter the place where the vehicle meters are in contact with the relevant vehicle meters on which an guide is placed or in operation and workers are in danger of faced with each other;

Nevertheless, on January 11, 2014, while the worker F, who was working at the above site, operated a water tank without a separate guide and moved the water tank, the Defendant did not allow workers to use cracks, etc. while allowing workers to use cracks, etc. using the boiler facilities used for the above road packaging and concrete production work, and did not take measures such as placing guides around the cracker, or controlling workers’ access to the cracker, while the worker F, who was working at the cracker work at the above site, moved the water tank to move without a separate guide, the Defendant fell from the above cracker of G workers with the water tank and the cracker line connected with the water tank under the cracker, resulting in the death of G due to damage to the cracker at around that time.

(b) On February 11, 2014, a business owner violating the Occupational Safety and Health Act of February 11, 2014 shall take protective measures, such as safety lines, fences, vertical fall telescopes, covers, etc. at places where workers might fall down, as the end or opening part of the work launch and passage, and shall install a cover, sounding, etc. on the parts where workers might face danger, such as machine motors, electric shocks, bells, and chains.
