1. The Plaintiff:
A. As to Defendant Non-Indicted Co., Ltd., the amount of KRW 275,454,639 and KRW 100,000,100 among them, the amount of KRW 275,454,639.
Reasons
1. Basic facts
A. The Plaintiff is an organization organized by the occupants to manage the four Atel-dong 262 households located in Suwon-si, Suwon-si and one other (1: 101 dong, 102 dong, 131 dong, and 131 dong, 202 dong, and 131 dong, and one other (131 dong, Dong, 202 hereinafter referred to as the “instant officetel”), and Defendant U.S. Co., Ltd. (hereinafter referred to as the “Defendant U.S.”), the instant officetel 1 complex, and the Defendant PYD D. C. (hereinafter referred to as the “Defendant PPC”) are the implementer who constructed and sold the instant officetel 2 complex, respectively, and Nonparty B Co., Ltd. (hereinafter referred to as the “B”) is the Defendant U.S. and the construction of the instant officetel 262 household, and the Defendant Co., Ltd. (hereinafter referred to as the “Defendant Co., Ltd.”).
B. On February 20, 2008, the Defendant Union entered into a contract for the repair of defects as to the instant officetel No. B and the instant officetel No. 1, and as to the instant officetel No. 2, the Defendant Association entered into a contract for the repair of defects as indicated below (hereinafter “each of the instant guarantee contracts”) with each of the following as the secured creditors, respectively.
After March 10, 2010, the guarantee creditor was changed from the defendant U.S. case and the NAWC to the plaintiff with respect to each warranty contract that falls under the Nos. 3, 4, and 5 of the table 1, 2010 as follows.
