The prosecution of this case is dismissed.

1. On July 14, 2016, at around 14:40, the Defendant committed an assault against the victim, such as: (a) the victim C and the parking problem; (b) the victim was frighted; (c) the head of the victim’s head; (d) the victim was shakened by his/her hand; and (e) the victim was boomed with his/her head; and (e) the victim’s head was knick and chest.

2. Article 327 subparagraph 6 of the Criminal Procedure Act, Article 260 (3) and (1) of the Criminal Act (an indication of non-existence of punishment on November 16, 2016, which is after the institution of public prosecution);
