Judgment

Although the amount of fraud of this case is not a large amount of money, it seems that the defendant paid interest exceeding the maximum interest rate under the Interest Limitation Act to the victim, considering this, considering the fact that the actual amount of damage of the victim seems not to be substantial, the defendant is the primary offender, there is no change of circumstances to be newly considered in sentencing in the trial, and all of the sentencing conditions in this case, such as the defendant's age, character, character, environment, career, circumstances of the crime of this case, means and consequence, etc., the sentence of the court below cannot be deemed to be unfair because it goes beyond the scope of discretion.

Therefore, prosecutor's assertion is without merit.

In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
