피고인은 2018. 3. 25. 00:00 경 오이도 행 지하철 4호 선 남태령 역부터 평 촌 역 부근을 지나는 지하철 객차 안에서, 승객인 피해자 B( 가명, 여, 27세 )에게 다가가 피해자를 빤히 쳐다보고 피해자의 어깨와 허리 부위를 만지기 위하여 손을 뻗었으나 피해자가 몸을 피하여 미수에 그치고, 계속해서 피해자 C( 가명, 여, 26세 )에게 다가가 가방을 들어준다는 핑계로 갑자기 피해자의 손을 잡고, 피해자가 이를 뿌리치고 다른 자리에 앉아 있자 재차 피해 자의 앞 쪽에 서서 피해자의 손을 잡고, 앉아 있던 피해자 D( 가명, 여, 23세) 의 왼쪽 허벅지 부위를 손으로 4회 만져, 피해자 B를 강제로 추행하려 하다가 미수에 그치고, 피해자 C와 피해자 D을 강제로 추행하였다.
